Dodik stressed that it is the essence
of the decision that the BiH Court should not have applied the 2003 Criminal
Code, about which Republika Srpska representatives had warned earlier, but that
both he and Republika Srpska were criticised for this.
“In any event, this will reinforce our
continuing political struggle against the BiH Court and Prosecution, which were
imposed by the high representatives and are outside the Dayton and
constitutional structure of BiH,” Dodik told reporters in Banjaluka.
The European Court of Human Rights
today ruled in the Maktouf and Damjanovic versus BiH case that the BiH Court
should not have applied retroactively the 2003 Criminal Code in two war crimes
cases.
After this decision, there is a
possibility for all rulings of the BiH Court in war crimes cases brought in
application of the BiH Criminal Code to fall.
