“The Republic of Srpska finds retroactive application of the
Criminal Code absolutely unacceptable, because it is a stricter piece of
legislation and we will state this clearly when the talks resume,”
Kovačević told Srna.
He said that the talks would focus on a working version of the law
on the Court of BiH, which prescribes that the State Court may in
certain matters exclude cases from the competence of the RS courts,
which are regulated by the RS Criminal Code.
”That is inadmissible and we won’t accept such legal provisions
proposed in the working version of the law on the Court of BiH,” said
Kovačević.
There will also be talk of redefining the role of the High Judicial and Prosecutorial Council of BiH, he said.
”The RS demands that the high judicial council be separated from the
high prosecutorial council, which has technically been accepted, and
that the election and appointment of prosecutors be performed by the
legislative institutions at all levels of government in Bosnia and
Herzegovina,” elaborated Kovačević.
