The then president of
Croatia Franjo Tuđman and president of Herceg-Bosna Mate Boban decided
that establishing Herceg-Bosna required a change to the ethnic structure
of the population.
In the majority of cases, crimes against Muslim population were not
committed by “a handful of soldiers,” they were rather part of a joint
criminal enterprise, reads the judgement, including a dissenting opinion
of the presiding judge.
The Chamber ruled that Tuđman, Chief of Croatian Army Main Staff
Janko Bobetko and Defence Minister Gojko Šušak, as well as the six
officials of Herceg-Bosna used the HVO for various aspects of the joint
criminal enterprise for the purpose of creating the Croatian Republic of
Herceg-Bosna.
